Western Military Officials Press ICC to Dismiss Arrest Requests for Netanyahu, Gallant

Their findings highlight that the delay in aid was a consequence of logistical challenges rather than a war crime. It was noted that the delay did not extend to a degree that would result in starvation among the Gazan population. Additionally, while prosecutor Khan claimed that Israel closed the Erez and Rafah crossings to humanitarian aid, the group found that Hamas had destroyed the Erez crossing and that the Rafah crossing's jurisdiction is shared with Egypt. These complex realities underscore the multifaceted challenges in such conflict zones.

While questions linger about why the Kerem Shalom crossing wasn't opened earlier, the investigation found no evidence suggesting Israel intentionally kept it closed to starve civilians. Furthermore, there is documented evidence indicating that Hamas intercepted aid intended for civilians, a situation the IDF actively worked to prevent.

The military group praised Israel's efforts to innovate evacuation methods for civilians from conflict zones. When civilian casualties occurred, they were found to be accidental rather than intentional. Moreover, the group argued that Khan's issuance of arrest warrants was premature, as Israel is conducting its internal investigations into alleged protocol breaches, with the IDF examining 300 such incidents.
